Pollacci and the woman had consensual sex once many years earlier, after she had been through a nasty divorce and before she moved out of state. He said they ended up in the loft of his liquor store, drinking wine and talking, on the night in question.

When she told him to stop, he did, telling her he wanted her to be there of her own free will. She stayed, they had a good time and slept together, Liu told the jury.

“Then, around 2 a.m., disaster strikes,” he said. As she was leaving the loft, she fell off the stairs, which had no railing and were described as steep, dangerous and “hellacious,” and “took a header,” Liu said.

But instead of calling 911, Pollacci panicked, thinking of the illegal living space he had upstairs.

The trial for Thomas Pollacci was on hold Friday while Judge Russell Scott tries to finish one trial to make room for another. Pollacci was scheduled to begin trial Monday.

His son, Jordan Thomas Pollacci, 20, is facing a preliminary hearing Friday on charges he burglarized two residences near downtown Pacific Grove on Jan. 4 and Feb. 15. He is being held in Monterey County Jail in lieu of $80,000. That preliminary hearing will likely be delayed. Liu is defending father and son.

Pine Cone reports that accused robber Jordan Pollaccii worked at Ron’s Liquor in P.G. Yes, the same liquor store that his father Tommy worked at.

I would not patronize businesses that employ rapists, robbers or domestic abusers.

Pollacci was taken into custody at the police department late Feb. 24. “He voluntarily came to the station, and during the course of the interview, he was arrested,” Engles said. He was lodged at Monterey County Jail on $80,000 bail.

Engles could not say how Pollacci is related to Pebble Beach resident Tom Pollacci, whose rape trial is set to take place later this month, but the younger Pollacci was often seen working in Ron’s Liquors on Lighthouse Avenue in Pacific Grove, which is owned by the Pollacci family and is the scene of the April 2008 crimes alleged against Tom
Pollacci.

Jordan Thomas Pollacci was arrested and booked into jail Wednesday and is being held on $80,000 bail.

Pollacci is suspected in the burglary of a house Jan. 4 and an apartment Feb. 15, police said. The break-ins happened near Lighthouse Avenue and 17 Mile Drive, police said.

The defense attorney for a Pebble Beach man charged with raping an unconscious woman said he has two experts who believe the alleged victim was injured when she fell, not during an attack.

Andy Liu plans to argue at trial that Thomas Pollacci had consensual sex with the woman and brought her to Community Hospital of the Monterey Peninsula after she sustained a severe head injury in a fall.

That trial, which was to have begun Monday, was continued to March 22 because the prosecutor needed time to review reports by a forensic pathologist and a biomechanical engineering professor hired by Liu.

Are we for some reason here drifting away from the REAL reason Tommy is in this situation? Rape. RAPE. The trial is for rape.

Agha’s plan for a 300-room hotel, which the developer has pursued for years, would still be possible even if the building’s first floor is leased to a retailer. Currently, the 60,000-square foot-space is occupied by antique dealers, a bank and a restaurant.

Judge Russell Scott set a Dec. 7 trial date for Thomas Pollacci, saying he wanted to finish the trial before the end of the year. Prosecutor Cristina Johnson and defense attorney Andy Liu estimated it would last three weeks.

Pollacci, 50, was arrested March 3 for allegedly raping a woman on April 20, 2008, at his family’s Pacific Grove business, Ron’s Liquors. Prosecutors say the woman was unconscious and suffering from an inflicted traumatic brain injury at the time.

On April 19, 2008, she came to the Monterey Peninsula to visit a friend and, after driving around, went into Ron’s Liquors to buy a pack of cigarettes, according to testimony by retired Pacific Grove Police Cmdr. Tom Uretsky. Pollacci recognized her, the two chatted for a few minutes, and she asked if he could get her through the gate at Pebble Beach. He told her he could and entered his number in her cell phone under the contact name, “Thomas My Love.” The following day, she tried to reach him but couldn’t. Later, he called and invited her to stop by the store, which she did.
