Judge Russell Scott set a Dec. 7 trial date for Thomas Pollacci, saying he wanted to finish the trial before the end of the year. Prosecutor Cristina Johnson and defense attorney Andy Liu estimated it would last three weeks.

Pollacci, 50, was arrested March 3 for allegedly raping a woman on April 20, 2008, at his family’s Pacific Grove business, Ron’s Liquors. Prosecutors say the woman was unconscious and suffering from an inflicted traumatic brain injury at the time.

A Pebble Beach man pleaded not guilty to a sexual assault charge this morning in a Salinas courtroom.

On April 19, 2008, she came to the Monterey Peninsula to visit a friend and, after driving around, went into Ron’s Liquors to buy a pack of cigarettes, according to testimony by retired Pacific Grove Police Cmdr. Tom Uretsky. Pollacci recognized her, the two chatted for a few minutes, and she asked if he could get her through the gate at Pebble Beach. He told her he could and entered his number in her cell phone under the contact name, “Thomas My Love.” The following day, she tried to reach him but couldn’t. Later, he called and invited her to stop by the store, which she did.

After hours sitting in front of a judge Friday, Tom Pollacci of Pebble Beach will stand trial on charges of rape.

His family owns Ron’s Liquor store on Lighthouse Ave. in Pacific Grove. Pollacci is accused of raping an unconscious woman back in April of 2008.

Pollacci could face a maximum sentence of eight years in prison.

He’ll be back in court at the end of this month. Pollacci is out on bail.

McGuirk testified she (Jane Doe #5) told him that one morning as she was getting ready for high school, there was a knock on her door. She answered and found Pollacci and another man, who threw her over his shoulders in her bathrobe and forced her into Pollacci’s car.

They drove her to the river in mid-Carmel Valley. The other man, whom she did not know, held her down while Pollacci raped her, she said.

Another woman said Pollacci, a friend of her ex-husband, raped her in her home during an unannounced visit more than 20 years ago. Another said he tried to rape her in the parking lot of the Highlands Inn after a luncheon date in 1992. That woman did report her assault to police, and Pollacci pleaded guilty to sexual battery.

Stamm, 47, exchanged brief hugs with well-wishers outside the courtroom, but kept his emotions in check, saying he was unsure how to feel.

“I have a lot of work to do. There’s a lot of damage control to be done, a lot of pieces of the puzzle that need to be put back together,” said the former owner of an indoor batting facility in Monterey and a miniature golf course in Pacific Grove. “I’m hoping to wake up tomorrow like Dorothy, and open my door and discover that life is all colorful again, and the black and gray will be gone.”

For the second time, the jury deadlocked on several charges that David Stamm molested a 14-year-old boy and showed him pornography. Stamm’s defense has said the alleged victim was 18-years-old at the time, and that the sexual encounters were consenual.

Stamm then said his life was like, “A broken bottle. There are many pieces I can pick up, but there are also many slivers that will still be missing.”

Maybe those slivers are in the victim . .

A prosecutor and defense attorney presented contrasting accounts Monday of the relationship between former batting cages owner David Stamm and a young friend who became his accuser.

According to prosecutor Glenn Pesenhofer, Stamm took advantage of an awkward teenager trying to find his way in the world, molesting him while telling him he was gay.

Quite to the contrary, defense attorney Richard Rosen said. “Peter” was on a vendetta because Stamm rejected him after the two had a consensual affair when the younger man was 18.

Deputy district attorney Cristina Johnson had asked the judge to up the bail to $1 million, citing public safety issues.

Since Pollacci’s arrest in early March hit the media, Johnson said, she had heard from new victims every day. “I received reports from eight different agencies, and calls from women who had been victims themselves or pointed to other women who had been victims,” she said.

Scott agreed but imposed several conditions of bail on Pollacci. He must remain at home, and may be subject to electronic monitoring, though he’ll be allowed to leave the Pebble Beach house of his parents to meet with his lawyers.

This grown man lives with his parents? OK, couple this with the other statement by his own defense team:

Pollacci was accompanied to his arraignment Tuesday by defense investigator Richard Lee, who wrote a presentence report in the 1993 case describing Pollacci as a spoiled, self-centered man who was guilty of being presumptuous and using poor judgment, but who did not realize he was having sex without consent. According to the report, Pollacci told Lee that he had come to realize through therapy that he never learned any “boundaries” in his life.

It all seems so clear now. If a minor commits a crime or causes damage, the parent of the child is held liable. This sex offender has not grown up. The boycott group is right, go ahead put some more blame on the Pollacci family, they might just deserve it. Shop for whisky, cigars & porn anywhere but their stores.
