It likely will be a few weeks before investigators can precisely say how two Nevada teenagers died during a scuba diving excursion Saturday off Cannery Row.

Stephen Anderson, 16, and Keegan Aiazzi, 17, were among a group of divers from a Carson City, Nev., high school oceanography class who went into the water from a commercial dive boat about a quarter mile from shore.

After they failed to surface and were reported missing, rescue divers from the Monterey Express charter boat found them on the ocean floor about 70 feet underwater, and they subsequently were pronounced dead at Community Hospital of the Monterey Peninsula.

The divers’ deaths, which left the tight-knit Carson City community in shock, is being investigated by the Monterey County coroner’s office and the Coast Guard. If foul play was suspected, Monterey police would handle the case.

First reported diver death this year.

Two teenagers drowned Saturday while scuba diving in Monterey Bay.

The divers were reported missing after others in their group surfaced and returned to their charter boat, the Monterey Express.

“Nineteen divers went down, two were reported missing,” said Felix Colello, a division chief for the Monterey Fire Department.

They were reported missing about 12:25 p.m.

“The two gentlemen were found on the bottom of the ocean,” Colello said. “They were brought up in cardiac arrest. We did CPR all the way to the hospital.”

The teens, 16 and 17 years old from Carson City, Nev., were pronounced dead at Community Hospital of the Monterey Peninsula.

Monterey Accused Of Violating HIPAA Rules In Raid

If HIPAA rules do not apply to marijuana sellers, how can it be legally called a medicinal drug?

“He opens up a HIPPA labeled file,” says Jhonrico Carrnshimba, a MyCaregiver director. “He sees a number of files in it at this point they should close the file. They shouldn’t have these files open.”

But, Fred Cohn from the City of Monterey defends their actions.

“Medical marijuana establishments are not governed by HIPAA,” says Cohn. “The only reason that those records were compromised is because they continued to operate illegally against the court order.”

Assistant City Manager Fred Cohn said the city filed notice Tuesday requesting the court ask MyCaregiver “to explain why it should not be held in contempt.”

Friday’s search, he said, turned up marijuana and documents indicating marijuana transactions were taking place at the co-op at 554 Lighthouse Ave.

Attorney Richard Rosen, who represents MyCaregiver co-founder Jhonrico Carr-Nshimba, said the city brought the contempt action “based on small technicalities about zoning and business licenses. It is completely ignoring the big issue, which is why is it legal everywhere else in California except Monterey?”

On Friday night, a woman was spotted going inside MyCaregiver and admits this isn’t her first time.

“I do have a medical marijuana card,” says client. “I probably go here once every week.”

The woman didn’t want Central Coast News to use her name, but said for the past year, she bought medical marijuana at the dispensary to treat anxiety and depression.

Cohn said Carr-Nshimba and at least one other MyCaregiver employee were on the premises at 554 Lighthouse Ave. when city code compliance coordinator David Wright and a police escort arrived, but refused to allow entry. After police forced their way inside, it took about an hour to search the premises, according to Cohn. There were no arrests.

The city sued MyCaregiver and Carr-Nshimba in February 2010, arguing that the operation violated the city’s zoning laws because they do not specifically accommodate medical marijuana facilities.

Judge Robert O’Farrell granted a temporary injunction against the operation last year, agreeing with the city that Carr-Nshimba had not been forthright on his business application by describing it as a “health care cooperative,” and said he would be distributing “herbal remedies.”

Hunter Harvath, assistant general manager of the transit agency, said he understands the nervous uncertainty behind the drivers’ concerns. But he said details of how the new taxi agency will work are still being worked out.

“We have not charged a penny to anyone yet,” he said. “We are still in the formulation period.”

He, too, denied the allegation that MST — which is governed by elected officials from cities and Monterey County — took on the taxi authority to spur bus ridership at the expense of cabbies.

“It’s nothing we asked for. We have our hands full trying to run a bus company,” he said.
