The insurance company investigating the missing art work case for the last two years rejected the $500,000 insurance claim stating in letters to Kennaugh’s attorney, “It is our belief that the misrepresentations and concealment were intentionally committed by Kennaugh and Angelo Amadio in order to obtain insurance benefits.”

Two weeks ago, the men fired back with a $2 million lawsuit claiming the insurance company acted in bad faith stating it was, “Conducting an oppressive and lengthy Examination Under Oath of plantiff in an effort to unduly harass, vex, annoy, and burden plantiff in an effort to discourage his pursuit of his claim…”

Last summer, Pacific Grove commissioned habitat scientists to conduct a thorough study of the conditions in the sanctuary, such as light, winds and placement of trees. The city said it will incorporate strategies proposed by the scientists into its new plan, as well as a system of feedback where the community can provide input.

One man who has given much for the sanctuary is Robert Pacelli. He spearheaded the campaign to bring potted eucalyptus trees to fill in the holes after the 2009 trimming.

His plan seemed to work. Pacelli said about 7,000 butterflies returned last winter, which was up from a paltry 700 or so the winter following the tree pruning. Numbers have been lower across the country, though, so the effect of the city’s trimming remains unclear.

“It’s a historic structure,” said Esther Trosow, with the Conservancy. “It’s on the list of historic structures and they let it fall into a state of decay. If any private citizen did that, according to the historic preservation rules, they would have to be in injunctive relief, which means they would have to fix it. And the city has just decided that they don’t need to do that. They’re thumbing their nose at their own laws.”

He works as an agent at Farmers Insurance on Lighthouse Avenue in Pacific Grove. His family owns that business. Also, at his home on Park Street, agents found up to 40 sex toys in a shed in his backyard.

If the parents think it’s not safe, drop them off somewhere else – they are not forced to use the front of the school, though it might be horrifying for them to not have their little snowflakes out of their sight.

Judy Smith’s children attend Pacific Grove Middle School, and she says Forest Avenue is simply too narrow, and busy for drop-off zones. Standing outside of the school, looking at a parade of cars drive by, Smith says, “This just makes no sense having it here on a busy street like this.”

The Center for Investigative Action wanted to know just how dangerous Forrest Avenue is, so we looked at the accident rates for the past ten years. Out of the 440 accidents on the roadway, only five were in front of the school. Pacific Grove Police Chief Darius Engles says, “The road is really no less safe than any of the roads in Pacific Grove.”

“Apparently water, too much water got in the soil and put too much pressure on a failing retaining wall and the retaining wall cracked and leaned over against the apartment building down below it,” says John Kuehl, Building Official for Pacific Grove and Monterey.

“It cheapens the experience down here to be handed chowder at every place in the wharf they walk at,” says Board Member Kevin Phillips. “We think it’s better off without it.”

Phillips, who also owns Abalonetti’s, said it’s been a problem for years. Now, he thinks it’s out of hand.

“This whole barking and oral advertising that goes along with it,” says Phillips. “A lot of people are uncomfortable with it.”

But other businesses like the Old Fisherman’s Grotto don’t agree.

“It’s a great thing,” says Owner Chris Shake. “Why would you want to take away something that is very positive for the wharf?”

Pacific Grove Police were called out to Wednesday’s city council meeting, expecting a riot about SmartMeters. The police presence caught many people off guard in the quiet town.

“I was surprised,” says Jerry Norton. “It seems to represent a different kind of attitude.”
