Scott also said Pollacci showed a great deal of “sophistication” and forethought in planning his attacks. And he quoted a letter from a woman who said she was one of Pollacci’s earlier victims. “He has no reason to live a productive life due to his family, who is willing to take care of him,” wrote the woman

Setting the stage for civil suit. I say go get ’em.

Until two months ago, thousands of shrieking seagulls would converge on the Marina landfill every day, distracting workers, pecking through trash and pooping everywhere.

The coastal birds have long flocked to the dump to feast on a smorgasbord of landfill leftovers, such as fast food, chicken bones and rotting fruit.

But that’s all changed. There are new birds in town, and they’re shaking things up.

“I don’t know where the seagulls are,” Monterey Regional Waste Management District general manager William Merry told The Pine Cone. “But they are not here.”

Since March, the MRWMD has contracted with a Turlock company to release falcons and other birds of prey to drive all but a few of the seagulls away.

Pacific Grove resident Timothy Petrick, 25, was jailed for felony drunken driving early last Sunday morning after allegedly driving over Carmel High School student Ryan Marden with his pickup truck while trying to get up a hill. The teen, who is the son of Carmel River School principal Jay Marden, and a friend had been sleeping under the stars at a Corral de Tierra property when the accident occurred, according to California Highway Patrol public information officer Bob Lehman.

William Gavin, the attorney for dog owner Donna Bazan and her father, Donald Armstrong — whom a jury found negligent because he didn’t do enough to stop the attack — filed a motion for a new trial and contends part of the jury’s award was unconstitutional.

“He asked Judge [Lydia] Villarreal to throw out parts of the jury verdict,” Ken Gorman, Ospina’s attorney, told The Pine Cone. “Specifically, the punitive damage award against Armstrong and the $7,500 for [Ospina’s] future pain and suffering.” In the motion, Gavin claims there was insufficient evidence to warrant punitive damages.

The burglary wasn’t a burglary, the ransom note wasn’t a ransom note, and the $80 million art heist wasn’t an $80 million art heist at all, according to Monterey County Sheriff’s Cmdr. Mike Richards. Though the men who reported being the victims in the Sept. 25, 2009, burglary of their Pebble Beach rental home, A. Benjamin Amadio and Ralph Kennaugh, have not yet been charged with any crimes, they apparently fabricated the art theft that made headlines across the nation.

The men, who also complained of unfair treatment, inaction and discrimination by the sheriff’s office, have been” quiet in recent months.

“We haven’t heard from them directly for some time. I understand now they moved over to Santa Cruz County,” he said. “They were evicted from the Pebble Beach house.”

But a PGUSD attorney filed a motion opposing the settlement offer contending it “would be grossly disproportionate” since King “bears all (or nearly all) liability” for the crash, court records say. “Ms. King is settling a multi-million lawsuit for $200,000, which bears no relationship to her potential liability,” according the motion filed by PGUSD attorney David W. Pollacci Rape Trial: Fear Of Revealing Loft Bedroom

In the tiny mind of Tom Pollacci, the liquor store business is more important than the well being of another human. Didn’t he read that illegal apartments can be made legit?

Pollacci and the woman had consensual sex once many years earlier, after she had been through a nasty divorce and before she moved out of state. He said they ended up in the loft of his liquor store, drinking wine and talking, on the night in question.

When she told him to stop, he did, telling her he wanted her to be there of her own free will. She stayed, they had a good time and slept together, Liu told the jury.

“Then, around 2 a.m., disaster strikes,” he said. As she was leaving the loft, she fell off the stairs, which had no railing and were described as steep, dangerous and “hellacious,” and “took a header,” Liu said.

But instead of calling 911, Pollacci panicked, thinking of the illegal living space he had upstairs.
