Councilman Poduri wanted the long awaited ATC Hotel property exempt. Maybe this disguise can skirt the law:

The vote did not come without some bargaining after Councilmember Chaps Poduri demanded the future American Tin Cannery luxury hotel project be specifically excluded from the ordinance.

Poduri told the council that he did not want any more potential conditions placed on the project, located on the Pacific Grove/Monterey border, just around the corner from the Monterey Bay Aquarium, and not far from the harbor seal pupping beach near Hopkins Marine Station.

He held his ground, refusing to vote for the ordinance as is, and although the other councilmembers argued that it concerned recreational drones only, not commercial, Poduri refused to budge.

The only issue, according to Ciani, was that some black oystercatchers and Heerann’s gulls were disturbed when a photographer tried to launch a drone near the auction tent.

Ciani added that the photographer was “very responsive to our concerns about wildlife disturbance,” and he later set the drone off near the lighthouse, which allowed him to film “without disturbing the birds on the way up.”

Harvey was unaware of the incident, and said he didn’t think it had been reported to city hall or the police, but said he would follow up with Ciani, the photographer and Worldwide Auctioneers.

Monterey Bay National Marine Sanctuary Superintendent Paul Michel, who yesterday issued a press release warning that unmanned aircraft systems—aka quadcopters or aerial drones—are regulated, and in some places banned, above sanctuary waters.
Low-flying planes over the beaches and ocean, piloted or not, can scare marine wildlife such as seals, sea otters, seabirds and shorebirds, Michel writes.

Even outside those areas, he adds, it’s illegal to harass marine animals, turtles and birds. In various direct and indirect ways, the presence of drones can stress and even kill wildlife.

Would Thom Akemans’s presence frighten the mammals? Will they ban him too?
