“During negotiations, a group of employees decided they didn’t want to be represented by the union and they circulated a petition that was signed by the majority of our employees,” Levenfeld explained.

“Based on the petition, we notified the union that the employees withdrew their recognition of the union. The union wasn’t pleased and made a series of accusations against us that we believe are false.”

Levenfeld said the inn has replaced the union’s health care plan for its employees with one that is fully paid by the employer and replaced the union’s retirement plan with a 401k option.

“It cheapens the experience down here to be handed chowder at every place in the wharf they walk at,” says Board Member Kevin Phillips. “We think it’s better off without it.”

Phillips, who also owns Abalonetti’s, said it’s been a problem for years. Now, he thinks it’s out of hand.

“This whole barking and oral advertising that goes along with it,” says Phillips. “A lot of people are uncomfortable with it.”

But other businesses like the Old Fisherman’s Grotto don’t agree.

“It’s a great thing,” says Owner Chris Shake. “Why would you want to take away something that is very positive for the wharf?”

A Northern California company has voluntarily recalled products sold at supermarkets across the West because they could contain contaminated broccoli. Tracy-based Taylor Farms Pacific announced the recall this week after a random test by agricultural officials came up positive for the bacteria Listeria monocytogenes.

Listeria monocytogenes can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems.

“Taxes shouldn’t be a tool for social engineering, or an instrument to penalize people for doing nothing wrong,” said J. Justin Wilson, a research analyst at the Washington, D.C.-based Center for Consumer Freedom, in a statement posted on the group’s website.

While Monning admits part of his goal is to change consumer behavior, he refuted the social engineering argument.

“The real social engineering is the massive corporate advertising that targets young people,” Monning said. “It’s open season on young people to market these beverages.”

Church Opens New Store: Everything’s Free

There are many stores that charge just $1 for most items, but the metropolitan area now has a store where everything on the shelves is free.

The first Free Store opened Saturday in Lee’s Summit and operators said they hope the public will help them make an impact.

The store is filled with clothes, coats and toys of all sizes.

Members of Heaven’s Gate Gospel Church collected donations to stock the shelves and they hope they can serve at least 500 families this season.

“It is sad to have to close, but it is awesome to know that we helped so many families during Christmas and during this extreme cold weather. Corey King, 22, of Pacific Grove, was arrested on felony warrants for driving under the influence, driving with a suspended license and petty theft with a prior.

The arrest came after King and two of his friends called for help when all of their backpacking gear, including matches and clothes, were soaked by rain. Officials said the men, who have been backpacking since Friday, had been in “grave danger” of freezing.

Following the rescue, officials learned that King had a felony no-bail warrant for his arrest. King was arrested for the warrant and the two other men and dog returned home.

KSBW-TV 8 announced Friday that KSBW-TV may no longer be carried on DirecTV satellite systems effective January 1, 2011, if the parties are unable to conclude retransmission consent negotiations currently underway.

Satellite distributors are prohibited by law from carrying broadcasters’ signals without their consent. The removal of KSBW’s signal from the DirecTV system will only result if negotiations between representatives of Hearst Television Inc., KSBW’s parent company, and DirecTV are unsuccessful in reaching a conclusion before December 31, 2010.
