An attorney for former Pacific Grove businessman Thomas Pollacci, 50, filed a motion to dismiss one of the rape charges, but a judge denied the motion Thursday afternoon.
Pollacci was sentenced to eight years in prison in June after a jury convicted him of raping a woman inside a loft above Ron’s Liquors in Pacific Grove.
